July 2010: Elena Kagan confirmed — to no one’s surprise except to those of us who expect the U.S. Supreme Court to be populated with talented, impartial jurists.
Kagan is not impartial. She is highly prejudiced and “believes” — her ideology that forms how she perceives laws, including hte Constitution — that the U.S. Constitution is subject to “international law” — that the U.S. Constitution “should be changed” (subjectively at the mercy of) the demands of “international law”. That means, that to Kagan, there is no United States of America sovereignity, there is only cultural whim, internationally, which leaves open the door for implementing Sharia Law in the U.S. or implementation of changes of our government by any other government depending upon the “whim” of whatever culture Kagan is sympathetic to, or is otherwise not contrary to what she rejects as ‘American’.
Unfortunately for our nation, these are also attitudinal views that are held by recently confirmed U.S. Justice Sonia Sotomayor. They are not only dreadfully Leftwing attitudes and beliefs, they are stridently anti-American perspectives that then searches for “aspects” or “parts” of the U.S. Constitution to accommodate that Leftwing political belief, and the result is, rather than respect the Constitution as it exists in total, as it is written, the Constitution becomes something like a food-storage bin from whence parts one likes can be retrieved while the rest is left in storage or worse, left to spoil as the part retrieved is enjoyed and put into the mix of *other things*.
Is there any surprise that Barack Obama would nominate both Kagan and Sotomayor to the Supreme Court and why? His dedication to “change” as to the U.S. has consistently involved his perspective of the U.S. as something else, another place, a different nation. His loyalties, appropriately called into question, have become more saturated in the issue of “foreign” if not often “treacherous” to this nation than anything resembling loyalty or fidelity to the U.S.A.

Elena Kagan was confirmed to a seat on the Supreme Court Thursday. The Senate voted 63-37, mostly along party lines, to make Kagan America’s 112th Supreme Court justice. —
…Senate minority leader Mitch McConnell (R) of Kentucky packed a host of objections to Kagan in his statement opposing her.
“Ms. Kagan’s background as a political operative, her lengthy resume of zealous advocacy for political and ideological causes, often at the expense of the law and those whose views differ from her own, her attachment to the president and his political and ideological goals, including his belief in the extraconstitutional notion that judges should favor some over others make her precisely the kind of nominee, in my view, the Founders were concerned about and that senators would have reason to oppose,” Senator McConnell said. My gratitude to both Senator McConnell and to Jeff Sessions for opposing Kagan’s confirmation to the U.S. Supreme Court. I wish our Senate had had more fortitude and sincerity in upholding our Constitution to withhold her confirmation accordingly.

Sen. Jeff Sessions, the top Republican on the Senate Judiciary Committee, has responded this morning to our report last night on Elena Kagan’s legal memos while she was a law clerk to Justice Thurgood Marshall.
Sessions called the documents “troubling” and said they “have to be carefully examined” as part of her confirmation hearings.
The remarkably candid documents provide some insight on her approach in a number of controversial social issues, from abortion to gun rights. Kagan has previously kept her views close, so liberals are certain to be encouraged by the memos, which indicate she may not be the moderate some had characterized her to be.
But as Sessions’ comments reflect, Republicans now have ammunition to use in the fight against her–and appear ready to use it.
“The newly unearthed memos reveal not only Ms. Kagan’s strong liberal views, but a willingness to bring those views into the courthouse – shaping and even replacing legal judgment,” Sessions said. “From issues such as guns to abortion to crime control, Kagan’s memos unambiguously express a leftist philosophy and an approach to the law that seems more concerned with achieving a desired social result than fairly following the constitution.” (– Continued).
